ORDER AND OPINION
THIS
CAUSE came before the Court on appeal, filed by Douglas David Heeder
(Heeder), from the Final Judgment, entered August 25, 2006. Upon review of the briefs, the record and
being otherwise fully advised, the Court affirms the trial court’s ruling as
set forth below.
The record shows that Heeder was the defendant in a breach of contract action brought by Dennis
J. Dowd (Dowd) to recover damages as a result of an unfinished roofing job
Heeder was contracted to perform. After
a non-jury trial, the trial court entered Final Judgment in favor of Dowd and
entered judgment in the principle sum of $ 3,392.50, plus costs and interest.
Before this Court, Heeder argues that the trial court erred in
granting final judgment in favor of Dowd.
The trial court’s interpretation of a contract is a matter of law
subject to a de novo standard of review.
